NPR publishes article on Sarah Crider settlement

December 2010

National Public Radio has published an article regarding the settlement obtained by CK&F for the death of Sarah Crider, a 14 year-old girl who died as a result of systemic neglect at Georgia Regional Hospital, a state mental facility. The settlement and related investigation by the Atlanta Journal Constitution sparked an investigation by the U.S. Department of Justice. In October, the State of Georgia agreed to spend $77 million over the next two years to move people out of the broken state mental health system as part of its settlement with the U.S. Department of Justice. The assistant attorney general for civil rights noted Sarah’s death moments before he announced the settlement with the State of Georgia. Click here to read the article.

CK&F obtains $1,000,000 tractor-trailer accident settlement

September 2010

CK&F has obtained a $1,000,000 settlement in case where our client sustained back, neck and other injuries when her car was struck by a tractor-trailer on I-285 in DeKalb County. Our client had to undergo a fusion of her lumbar spine and blocks in her neck. The case was resolved shortly after CK&F filed a Motion for Sanctions based upon a showing that the trucking company had destroyed evidence.

CK&F Partner Alwyn Fredericks and attorneys Fred Orr and Smokey Edwards have obtained a verdict of $9,250,000 in DeKalb County in the case of Howard v. Boston Men’s Health Center, Inc. The case involved a Georgia man who was treated at a Boston Medical Group facility in Georgia for erectile dysfunction and suffered permanent injuries as a result. The jury agreed that employees of Boston Men’s Health Center, Inc. falsely misrepresented their treatment as safe and as a “cure” for erectile dysfunction. The jury’s verdict included $750,000 in compensatory damages and $8,500,000 in punitive damages. Click here to view the Fulton County Daily Report’s article on the verdict.

CK&F obtains settlement of $1,000,000 from the Georgia Department Human Resources

November 2008

CK&F has obtained a settlement from the Georgia Department Human Resources (DHR) of $1,000,000 for the death of Michael Webb. Michael died as a result of gross, systemic neglect at Georgia Regional Hospital. The AJC reported on Michael’s death as part of its investigation into the state’s mental health system. At that time, the DHR refused to accept any responsibility for Michael’s death. Despite requests from the family for an apology, the State refused to give one. The AJC has published an article on the settlement, noting that the State could have resolved the case for less if they had taken responsibility for their actions and issued an apology to the family. CK&F files lawsuit against several manufacturers of Gadolinium-based MRI contrast dyes

When administered to patients with renal problems or failure, the dyes can cause a debilitating condition known as Nephrogenic Systemic Fibrosis, or NSF. The FDA has received hundreds of reports of patients developing NSF after administration of Gadolinium dyes. For more information about this litigation, click here.

CK&F has obtained a settlement from the Georgia Department Human Resources of a $1,250,000 for the death of Sarah Crider, a 14 year-old girl who died as a result of negligent treatment she received at Georgia Regional Hospital, a state mental health hospital. Sarah’s death was featured in the AJC’s investigation into the state’s mental health system. It is the largest settlement obtained from the State involving a mental health patient. New Atlanta Journal Constitution article investigating Georgia’s mental health system

The Atlanta Journal Constitution has published another article in its series investigating Georgia’s mental health system, detailing the death of Michael Webb after being hospitalized at Georgia Regional Hospital. Like Sarah Crider, Michael died from a bowel obstruction that went untreated despite alarming signs and symptoms. The Georgia Department of Human Resources spokeswoman announced that the state “accepts no blame for Webb’s death.” Cash, Krugler & Fredericks is representing Michael’s family in their wrongful death case against the State.
